Commercial lease

What to check before signing a lease

For commercial property the rental rate is just one element of the cost and lease terms. Before signing a lease it is worth also analysing additional charges, indexation rules, the lease term and termination conditions.

Service charge

Building operating and maintenance fees may be charged separately from the base rent. We check their scope and calculation method.

VAT

VAT treatment depends on the specific transaction and the parties' status. We verify which amounts make up the actual cost of the lease.

Rent indexation

We check the rules for adjusting the rate in subsequent years and the index specified in the lease.

Fit-out

For premises requiring adaptation we analyse the conditions regarding fit-out works and the landlord's possible contribution to their cost.

Rent-free period

Depending on the property and transaction terms it may be possible to negotiate a period without the base rent, for example during premises preparation.

Lease termination

We analyse the lease term, the possibilities for early termination and the associated conditions and obligations.

Questions and answers

Frequently asked questions about commercial property

Who can rent commercial property in Poland?

Landlords typically sign agreements with registered businesses — sole traders (JDG) or companies. Depending on the property, documents may be required: KRS (company register extract), NIP (tax number), REGON (statistical number) or a CEIDG extract.

How much does it cost to rent an office?

It depends on the building class and location — modern Class A offices in city centres cost more than Class B offices in business districts outside the core. Service charge and 23% VAT are added on top of the base rate. We calculate the full cost for your specific requirements free of charge.

What is service charge and who pays it?

Service charge is an operating fee for building management — security, cleaning and building services. It is paid by the tenant, separately from the base rent. We always check this item before a lease is signed.

What is the difference between najem (lease) and dzierżawa (tenancy)?

Najem is the standard agreement for an office, retail unit, warehouse or other commercial space. Dzierżawa more often covers land, production facilities or a going business, where the tenant gains the right to use the asset and derive economic benefit from it. We help select the appropriate type of agreement.

Can you negotiate with the landlord on price?

Yes, and it is well worth doing. Beyond a reduction in the base rate, it is often possible to negotiate a rent-free period during fit-out and a landlord contribution to fit-out costs. We conduct these negotiations on the client's behalf.

Can a premises be rented remotely?

Yes. We organise online viewings, review documents remotely, conduct negotiations and accompany you at signing — without requiring the tenant's physical presence at every stage.
