Legal Support for Real Estate Transactions
We verify documents, the agreement and the legal status of the property before you sign anything. We coordinate lawyers, a notary and a sworn translator within a single transaction.
Where needed we bring a lawyer, notary or sworn translator into the process and coordinate their work within a single transaction.
When it is worth using legal support
A property purchase involves documents, obligations and decisions whose consequences may also arise after the transaction is concluded. The scope of verification is tailored to the property and the buyer's situation.
You found the property yourself
If you found an apartment or house on a listing portal or directly from the owner, we can check the property and documents before you sign an agreement or pay a deposit. We verify title, the land register, available documents and circumstances that may be relevant to the transaction.
Buying property in Poland
We can accompany you through the entire process — from property verification and agreement analysis to preparation of the notarial deed and coordination of transaction-related formalities.
Buying as a foreigner
We help navigate the additional formalities that may arise when a foreigner purchases property. Where needed we coordinate the involvement of a sworn translator and legal support for the MSWiA permit process.
Scope of legal support for transactions
The scope of engagement may include a single document review or comprehensive support for the entire transaction. Before starting work we determine what actions are needed in the specific situation.
Legal status verification
We analyse the land register, title documents and available information about the property. We check disclosed encumbrances, third-party rights and other matters that may be relevant to the planned transaction.
Agreement and document analysis
We analyse purchase, preliminary, reservation, developer, lease and other agreements related to the property. We explain the material terms, the parties' obligations and the consequences of signing the document.
Notarial deed preparation
We coordinate documents and formalities needed to complete the transaction at the notary. Where needed we also help arrange a sworn translator.
Support for developer purchases
We analyse project-related documents and the terms of the reservation or developer agreement. We pay attention to timelines, payment terms, withdrawal conditions, penalty clauses and provisions on the parties' liability.
MSWiA permit
If the property type or the buyer's situation requires a permit for a foreigner to acquire property, we help determine the necessary formalities and coordinate cooperation with the lawyer handling the procedure.
Sworn translator
If a sworn translator is required for the transaction, we help arrange one and coordinate the transfer of documents needed to prepare for the procedure.
Transaction-related formalities
Depending on the scope of engagement we help coordinate formalities that need to be completed before or after the transaction, and indicate which matters require the involvement of a notary, lawyer, tax adviser or other specialist.
Occasional tenancy (najem okazjonalny)
We handle the preparation of najem okazjonalny documents as a separate service. It covers the preparation of required documents and instructions for further steps.
Learn about the najem okazjonalny service →How legal support for a transaction works
First we learn about the situation and documents, then determine the scope of the necessary verification and next steps.
Learning about the situation
We discuss the property, the transaction stage and the documents the client already has. We also determine whether a single analysis or broader support for the entire process is needed.
Verifying the property and documents
We analyse the legal status of the property and available documents. We identify matters requiring clarification before further commitments are made.
Analysing the agreement
We review the document the client is to sign and explain its material terms. If certain provisions require additional clarification or amendment, we discuss them before signing.
Coordinating transaction completion
We help prepare documents and the subsequent stages leading to the transaction. Where needed we coordinate cooperation with the notary, lawyer or sworn translator.
Assisting with further formalities
After the transaction we indicate further formalities arising from its nature and — within the agreed scope — help coordinate their completion.
One transaction, different specialists
Not every transaction requires the involvement of all specialists. However, where needed we coordinate their work so the client does not have to organise each element of the process independently.
Lawyers
For matters requiring specialised legal analysis we work with lawyers experienced in property and transactions on the Polish market.
Notaries
We coordinate preparation for the notarial procedure and communication regarding documents needed to conclude the transaction.
Sworn translators
Where needed we arrange a sworn translator for the notarial procedure or translation of transaction-related documents.
Specialists for non-standard matters
If the transaction requires additional analysis — for example in connection with an MSWiA permit, a complex legal status or another special situation — we coordinate the involvement of the appropriate specialist.
Frequently asked questions about legal support
What is legal property verification and why does it matter?
It is an analysis of documents, title, any encumbrances, debts and other legal risks that could affect the buyer after the transaction. It includes reviewing the land register (księga wieczysta), the owner's documents and property information. This verification helps avoid serious financial and legal problems after purchase.
Is a translator needed for a notarial transaction?
If the client does not have a sufficient command of Polish, the notary will usually require a sworn translator to be present. We arrange this support and explain the full substance of the transaction and documents before signing.
What is an MSWiA permit and who needs one?
Citizens from outside the European Union may need a permit from the Ministry of Interior (MSWiA) to purchase a house, land plot or certain other property types. Most apartments and flats can be purchased without such a permit. We assess the client's situation at the outset and guide them through the entire process if a permit is required.
Can you review just a single agreement without full transaction management?
Yes. We offer standalone legal consultations and can review a specific agreement — lease, purchase, deposit or any other document — without managing the full transaction. The form of engagement and cost are agreed individually.
What is najem okazjonalny and what is its purpose?
Najem okazjonalny is a special form of tenancy agreement in Poland (art. 19a of the Tenants' Rights Act) that provides additional protection for the property owner. The agreement is concluded together with a notarial declaration by the tenant and significantly strengthens the landlord's legal position.
How much does legal support for a transaction cost?
The cost depends on the scope of work: document verification, agreement review, full transaction management or a single consultation. The first consultation is free of charge. We confirm the service price before work begins.
