Najem okazjonalny

What is najem okazjonalny

Najem okazjonalny is a special form of tenancy provided for under art. 19a of Poland's Tenants' Rights Act (ustawa o ochronie praw lokatorów). If the tenant breaches the agreement, the process of recovering the property is far simpler than under a standard tenancy — the tenant signs a notarial declaration of voluntary submission to enforcement proceedings under art. 777 of the Code of Civil Procedure (Kodeks postępowania cywilnego) and provides an alternative address to which they could move.

For the tenant this arrangement is also beneficial — it is an official agreement with clearly defined conditions of occupancy, payments and duration, typically concluded for a longer period. With the landlord's agreement, this type of tenancy also allows the tenant to register their address at the property.

Frequently asked questions

Frequently asked questions about najem okazjonalny

How does najem okazjonalny differ from a standard tenancy?

Najem okazjonalny is a special form of tenancy under art. 19a of Poland's Tenants' Rights Act. The key difference is the additional notarial documentation, which gives the landlord enhanced legal protection — the process of recovering the property in the cases provided by law is significantly simpler than under an ordinary tenancy. For the tenant it means clearly defined tenancy conditions and transparent rules of occupancy.

What is included in the document preparation service?

The service includes: preparation of the tenant's declaration, the alternative-address owner's declaration, verification of document accuracy, notarial certification instructions and delivery of the complete pack.

Who is required to register the agreement with the tax office?

The obligation to notify the Tax Office (Urząd Skarbowy) falls on the landlord. Under Polish law the landlord must register the agreement within the prescribed period from the commencement of the tenancy — failing to do so may cause the landlord to lose the right to use the simplified enforcement procedure available under najem okazjonalny.

What if I have no one to name as the alternative address?

Najem okazjonalny requires naming an address to which the tenant could move if the tenancy ends. We work with property owners who can help prepare such a declaration in compliance with legal requirements, if you have no one to ask for this address.

Do all documents need to be certified by a notary?

No. Only the tenant's declaration under art. 777 of the Code of Civil Procedure (k.p.c.) requires notarial certification. The remaining documents are prepared in written form in accordance with legal requirements.

How much does it cost to prepare najem okazjonalny documents?

The cost of the complete document pack with delivery anywhere in Poland is 500 zł. Personal collection in Warsaw on the same day is also available.
